Privacy Policy

This Privacy Policy explains how TeleWellnessMD® and our affiliated entities (“TeleWellnessMD,” “we,” “us,” “our”) collect, use, disclose and protect information when you visit or interact with our websites, patient portals, affiliate dashboards or other online services that link to this Privacy Policy (collectively, the “Services”). By using the Services, you agree to this Privacy Policy and our Terms of Service. If you do not agree, do not use the Services.

HIPAA note: Some information we receive or create in connection with your clinical care may be Protected Health Information (“PHI”) and is governed by our HIPAA Notice of Privacy Practices. When HIPAA applies, that Notice controls how PHI is used and shared. This Privacy Policy covers information collected through our Services that is not PHI.

1. Scope of this Policy

  • Applies to activity on our websites, portals, mobile or web applications, communications tools, and related online features that link to this Policy
  • Does not apply to third-party sites or services we do not control
  • Does not alter any rights you may have under our HIPAA Notice of Privacy Practices

2. Information We Collect

The information we collect depends on how you use the Services.

Information you provide directly

  • Contact and account details – name, email, phone, mailing address, date of birth
  • Care coordination information – your preferred pharmacy, order details, shipping choices
  • Health context you choose to share through the Services – symptoms, medications, questionnaires, photos for clinical review, insurance information (may be PHI when used for care)
  • Identity and verification information – government ID image or number, signature where required by law
  • User-generated content – feedback, reviews, posts in permitted areas, file uploads
  • Communications – messages to support or care teams including chat and email

Information collected automatically

  • Usage and device data – IP address, device identifiers, browser type, operating system, pages visited, links clicked, time on page, crash or error reports
  • Approximate location – city, state, or ZIP inferred from IP or browser settings
  • Cookies, SDKs, and similar tools – to remember preferences, maintain sessions, measure traffic, improve features and provide advertising or analytics (see Cookies & Similar Tools)

Information from other sources

  • Licensed providers, pharmacies, laboratories and partners that support your care or orders
  • Payment processors and fulfillment partners
  • Analytics, security and fraud-prevention vendors
  • Social or identity providers when you choose to connect accounts

Sensitive personal information
Depending on your use of the Services, we may process health data, government ID and precise images used for identity or clinical review. We handle such data in accordance with applicable law and our HIPAA Notice when PHI is involved.

3. How We Use Information

We use information to:

  • Operate, maintain, and secure the Services
  • Coordinate care with licensed providers and pharmacies, fulfill orders and provide patient support
  • Communicate about accounts, orders, refills, appointments, service updates and legally required notices
  • Personalize experiences and content, support accessibility and improve usability
  • Perform analytics, quality assurance, research and product development using aggregated or de-identified data where possible
  • Detect, investigate and help prevent fraud, abuse and security incidents
  • Comply with laws, regulations and legal process and enforce our terms and policies

Where required, we will obtain your consent before using or processing certain sensitive data for non-essential purposes.

4. Artificial Intelligence (AI) Disclosures

We may use AI-enabled tools to help with tasks like content personalization, response suggestions, pattern detection and operational analytics. Clinical decisions always involve qualified human oversight. Any vendors that support AI features must meet our security and privacy requirements, and we apply the same data safeguards described in this Policy and our HIPAA Notice when applicable.

5. Online Analytics, Advertising and Your Choices

We use first-party and third-party tools (for example, cookies, pixels, SDKs and web beacons) to:

  • Measure traffic and usage patterns across devices
  • Improve performance and fix problems
  • Deliver and measure the effectiveness of content and advertising about our Services on our sites and others

Choices

  • Browser or device settings – block or delete cookies, reset mobile advertising IDs
  • Platform controls – manage ad preferences with Google, Meta, TikTok and others
  • Global Privacy Control (GPC) – where legally required, we treat a valid GPC signal as an opt-out of targeted advertising or sale/sharing of personal information
  • Email – unsubscribe links in marketing emails or email support@telewellnessmd.com
  • Your Privacy Choices – visit telewellnessmd.com/privacy-choices to exercise available rights and opt-outs related to targeted advertising or sale/sharing where applicable

Even if you opt out, you may still see non-personalized ads.

Do Not Track: We do not respond to browser-initiated DNT signals. We honor legally required browser-based opt-out signals as described above

6. How We Share Information

We may disclose information as follows:

  • Care delivery – to licensed healthcare providers, pharmacies and labs to coordinate treatment, payment and operations
  • Service providers – companies that help us operate the Services, process payments, provide shipping, analytics, security, customer support and IT
  • Compliance and safety – to comply with law or legal process, enforce our terms, protect rights, property or safety
  • With your direction or consent – when you ask us to share or connect with a third party
  • Aggregated or de-identified data – for research, insights or improvement. We do not attempt to re-identify such data, and we contractually prohibit our recipients from doing so

We do not share PHI in ways that conflict with HIPAA or our HIPAA Notice of Privacy Practices.

7. Your Rights and State Notices

Depending on where you live, you may have rights to:

  • Access, obtain a portable copy of or confirm processing of your personal information
  • Correct inaccurate information
  • Request deletion
  • Opt out of targeted advertising, sale or certain profiling
  • Appeal a denial of your request

Submit requests via telewellnessmd.com/privacy-choices or email support@telewellnessmd.com. We will verify your identity before fulfilling requests. Authorized agents may submit requests with proof of authority. Some information may be exempt from deletion or access under applicable law or to complete transactions, meet legal obligations or protect security.

California (CCPA/CPRA) disclosures

Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), TeleWellnessMD® provides the following summary of how we collect, use, disclose and retain personal information.

  • We may “share” or “sell” personal information as those terms are defined by California law in connection with cookies, advertising, and analytics. You can opt out at telewellnessmd.com/privacy-choices or via a recognized browser-based signal where required.
  • We do not knowingly sell or share the personal information of consumers under 16.
  • Shine the Light: We do not disclose personal information to third parties for their own direct marketing purposes.

Nevada privacy disclosures

  • We do not sell covered personal information for monetary consideration under Nevada law. Nevada residents may submit opt-out requests to support@telewellnessmd.com.

8. Cookies & Similar Tools

Cookies, pixels, web beacons, local storage and SDKs help us remember preferences, keep you signed in, measure performance, combat fraud and provide relevant content. You can manage cookies in your browser settings. Blocking some cookies may limit certain features

9. Information Security

We use administrative, technical and physical safeguards to protect information – including encryption in transit, access controls, logging, secure development practices and vendor due diligence. No method of transmission or storage is completely secure. Please avoid sending sensitive information by unencrypted email.

10. Data Retention

We keep information only as long as necessary for the purposes described in this Policy, to deliver Services, to comply with legal and regulatory requirements, to resolve disputes and to enforce agreements. PHI retention follows applicable healthcare recordkeeping laws and our HIPAA Notice.

11. Children

The Services are intended for adults 18+. We do not knowingly collect personal information from individuals under 18 through the Services. If you believe a minor has provided information, contact us at support@telewellnessmd.com and we will take appropriate steps.

12. Third-Party Sites and Services

The Services may link to third-party websites or tools we do not control. Their privacy practices apply to their services. Review their policies carefully before sharing information. When you connect third-party accounts or devices, you direct us to receive information from those providers per your settings.

13. Changes to this Policy

We may update this Privacy Policy from time to time. The “Last updated” date shows the most recent changes. Material changes will be posted on the Services. Your continued use after an update means you accept the revised Policy.
